Share and Care Homeshare will only undertake business on the following Terms & Conditions. These terms are legally binding, so please read them carefully.
- The acceptance of a Sharer introduced by Share and Care Homeshare will be deemed as acceptance of these Terms & Conditions.
- The word “Sharer” refers to a person who is working or studying and who Share and Care Homeshare has introduced as available for sharing with the Householder.
- The Householder will be charged a fee upon Registration, payable by card or bank transfer. The Registration Fee charged covers for up to a 6-month search for a Sharer although, in most cases, a Sharer is found much sooner. This fee is for a one engagement only and is non-refundable.
- After offering a Homeshare to a Sharer, Share and Care Homeshare will charge the Householder a monthly Homeshare Fee (as published on the fee sheet) for the duration of the Homeshare Arrangement. The first monthly fee is payable on or before the date the Sharer moves in and is non-refundable; thereafter the fee is payable each calendar month by Direct Debit (or an alternative payment method which must be agreed with Share and Care Homeshare).
- A 28-day notice period is required to terminate the Homeshare Licence Agreement with Share and Care Homeshare and the Homeshare Fee is payable for the full 28-days’ notice period.
- Share and Care Homeshare will charge a Finder’s Fee if a Homeshare arrangement is superseded by a private arrangement which negates the Homeshare Licence Agreement.
- The Licence comes into effect from the date the Sharer moves in with the Householder, whether executed or not.
- Any failure to pay fees where due will incur interest at the rate of 4% above the base rate of Barclays Bank plc from time to time on any outstanding balance from the date the sums became due.
- All information is confidential and must not be passed to a third party, either directly or indirectly, or in breach of data privacy laws (GDPR). If information is passed to a third party, and a Sharer is booked/engaged otherwise than through Share and Care Homeshare, this will constitute a breach of our Terms and Conditions, and our standard fees will be charged to the Householder.
- The Sharer is not to administer any medication or provide medical care in any way to the Householder, except in the case of an emergency where the Sharer may undertake basic First Aid and must call for an ambulance.
- The Sharer is not to act as a carer for the Householder and is not to undertake personal care (i.e. physical assistance given to a person in connection with eating or drinking; toileting; washing or bathing; dressing; oral care; care of skin, hair and nails) or otherwise act in any way that may be considered as a carer for the Householder.
- The Householder must not offer gifts beyond small expressions of affection (any gift offer of value over £50 should be reported to Share and Care Homeshare); must not make the Sharer a beneficiary of a will or a signatory on the Householder’s bank account; must not lend money to the Sharer; must not ask the Sharer to use the Householder’s bank card or PIN to withdraw money.
- In the event that the Householder cancels the booking after offering a homeshare arrangement to a Sharer but prior to commencement, Share and Care Homeshare reserves the right to charge 100% of the first monthly facilitation fee for work incurred. The Householder should also be prepared to compensate the assigned Sharer for loss of accommodation should the Sharer find themselves temporarily homeless as a result. Share and Care Homeshare recommends the Householder pays for up to a maximum of 7 days for alternative accommodation if that is the case.
- The Householder is required to ensure that their property is safe and suitable for a Sharer.
- The Householder must have their boiler and gas appliances serviced annually by a Gas Safe registered engineer. It is also the Householder’s responsibility to ensure that fixed electrical installations and appliances supplied must be safe. It is also the responsibility of the Householder to have adequate buildings and contents insurance for the property.
- Whilst Share and Care Homeshare interviews all potential Sharers and tries to ensure full reference checks are carried out, it is ultimately the sole responsibility of the Householder to satisfy themselves as to suitability.
- Share and Care Homeshare gives no guarantee regarding the capability, character, medical condition, age or suitability of the Sharer. While Share and Care Homeshare endeavours to verify the background of Sharers introduced before a situation commences, it cannot guarantee that all the information provided regarding the Sharer is accurate.
- Share and Care Homeshare reserves the right to use its own discretion with regard to any situation or issue not itemised in its terms.
- Share and Care Homeshare is not an agent for either the Householder or the Sharer. The programme acts as a facilitator, supporting both parties to agree an acceptable housing arrangement.
- Share and Care Homeshare, its management and employees cannot be held responsible for any claims, damages or consequences that may arise from a homesharing arrangement.
- Share and Care Homeshare’s Conflict Resolution Procedure is available on request.
- Share and Care Homeshare is not required to undertake any personal visits to monitor the arrangement, but will give telephone and email support and advice. The Householder and Sharer should endeavour to make the arrangement work through good communication. The homeshare fee is payable monthly in advance, for the duration of the match. The first invoice is due on or before the date the Sharer moves in and is non-refundable. Invoices are payable within 7 days of the invoice date.
Please note that the Sharer also pays Share and Care Homeshare a monthly Homeshare Fee. The Sharer is not an employee, and the Householder and the Sharer do not pay each other.
The Householder normally remains responsible for paying household and utility bills.
If the Sharer is not exempt from Council Tax (full-time students are exempt), you will be responsible for approaching your council to find out if your Sharer can be exempted due to the care and support they will be giving you. If they are not exempt and you lose your Single Person’s discount as a result, you may wish to ask your Sharer to contribute towards Council Tax and household bills – up to £60 per month; this amount should be discussed with Share and Care Homeshare and mutually agreed with the Sharer before the commencement of the Share.
The Sharer is normally responsible for paying for his/her own food and phone bills.
Terms and Conditions:
In the event that the Householder wishes/needs to cancel the booking after its arrangement, but prior to commencement, due to extenuating circumstances, Share and Care Homeshare reserves the right to charge 100% of the first month’s fee for work incurred. The Householder should also compensate the assigned Sharer for loss of accommodation.
